End User License Agreement

This is a legal agreement between you ("Licensee") and DumboFab Software ("Licensor") . Please read the following terms and warranties before using DumboFab Software products ("Software"). By installing the Software, you agree to be bound by this License Agreement.

Grant of License

DumboFab Software hereby grants to you (an individual) the revocable, personal, non-exclusive, and nontransferable right to install and use the Software on no more than one computer solely for personal and non-commercial use. The rights and obligations of this Agreement are personal rights granted to the Licensee only. Sharing this Software with any other person, or allowing other individuals to view the contents of this Software, is in violation of this license. You may not make the Software available on a network, or in any way provide the Software to multiple users, unless you have first purchased at least a multi-user license from Licensor.

"The Software programs are owned by DumboFab Software and protected by copyright law and international copyright treaties. You may not remove or conceal any proprietary notices, labels or marks from the Software."

Restrictions on Use

You may not, and you may not permit others to:

De-compile, reverse engineer, decode, decrypt, disassemble, or in any way derive source code from the DumboFab Software;

Modify, distribute, or create derivative works of the DumboFab Software;

Copy, distribute, publicly display, transmit, sell, rent, lease or otherwise exploit the DumboFab Software;

Term

This Agreement is effective until terminated. You may terminate it at any time by destroying the Software, together with all copies thereof. This License will also terminate if you fail to comply with any term or condition of this Agreement. Upon such termination, the Licensee will destroy DumboFab Software, together with all copies thereof.

No Other Warranties

Licensor does not warrant that DumboFab Software is error free. The Licensor makes no other warranties expressed or implied concerning the merchantability and fitness of the Software for a particular purpose and no infringement of third party rights. Some jurisdictions do not allow the exclusion of implied warranties of limitations on how long an implied warranty may last, or the exclusion or limitation of incidental or consequential damages, so the above limitations of exclusions may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from jurisdiction to jurisdiction.

Cover CD

The reproduction and distribution of DumboFab Software (evaluation copy only) in various Cover CDs published by associated magazines are allowed. However a copy of magazine with CD is required to be sent to the Licensor.

Severability

In the event of invalidity of any provision of this license, the parties agree that such invalidity shall not affect the validity of the remaining portions of this license.

Limitation of Liability

In no event shall the Licensor or its suppliers be liable to you for any consequential, special, incidental, punitive, direct or indirect damages or any kind arising out of the delivery, performance or use of the Software, even if the Licensor has been advised of the possibility of such damages. In no event will the Licensor liability for any claim, whether in contract, tort or any other theory of liability, exceed the license fee paid by you, if any.

Acknowledgment by installing DumboFab Software, you acknowledge that you have read and understand the fore going and that you agree to be bound by its terms and conditions. You also agree that this agreement is the complete and exclusive statement of agreement between the parties and supersedes all proposed or prior agreements, oral or written, and any other communications between the parties relating to the license described herein.

User Requirements and Obligations

1. 1. Users will comply with all applicable laws in connection with use of DumboFab Software programs.
2. 2. DumboFab Software respects the intellectual property rights of others, and requests you to do the same. When using DumboFab Software programs to rip or copy DVDs and Blu-rays, users should abide by your country or local DVD and Blu-ray copyright protection law. Do NOT make illegal pirated movies after DVD/Blu-ray ripping or damage the interests of copyright owners. Use DVD or Blu-ray ripper to backup DVDs or Blu-rays under the concept of Fair Use.
3. 3. Any unauthorized reproduction, retransmission or modification of any of the contents of copyrighted owners may be in breach of statutory or common law rights which could be the subject of legal action. The Licensor reserves the right to immediately terminate User's use of, or access to, the site at any time if the Licensor, in its sole discretion determines that the Licensee has breached this Agreement, or any relevant law, rule or regulation or that the Licensee has engaged in conduct or behavior that the Licensor considers to be unacceptable or inappropriate.
